1. Introduction & Scope

This Privacy Policy explains how Renkara Media Group ("Renkara," "we," "us," or "our") collects, uses, shares, and protects your personal data when you use the AccelaStudy® AI application and related services (collectively, the "Service").

This policy applies to all users of the Service worldwide, including users in the European Economic Area (EEA), the United Kingdom (UK), the State of California, and all other jurisdictions. Where local laws grant you additional rights, those rights are described in the relevant sections below.

By using the Service, you acknowledge that you have read and understood this Privacy Policy. Where we rely on consent as a legal basis for processing, we will obtain your explicit consent before collecting or processing your data.

3.3 Data We Do Not Collect

We do not collect precise geolocation data, biometric data, financial account numbers, government-issued identification numbers, or health information.

4. How We Use Your Data

We process your personal data only for the purposes described below. For users in the EEA/UK, we identify the lawful basis under GDPR Article 6 for each purpose.

Where we rely on legitimate interest, we have conducted balancing tests to ensure our interests do not override your fundamental rights and freedoms.

5. Cookies and Tracking Technologies

5.1 Mobile Application

The AccelaStudy® AI mobile application does not use browser cookies. We use a device vendor identifier (Device ID) to associate your device with your account and to collect analytics data.

5.2 Website

If you visit our website, we may use:

Strictly Necessary Cookies: Required for the website to function (e.g., session management). These do not require consent under ePrivacy rules.
Analytics Cookies: Used to understand how visitors interact with our website. These are only set with your prior consent, in compliance with the ePrivacy Directive.

You can manage your cookie preferences through your browser settings or through any cookie consent mechanism presented on our website. Withdrawing consent for non-essential cookies will not affect the functionality of the Service.

5.3 Do Not Track

We honor Do Not Track (DNT) browser signals. When we detect a DNT signal, we do not load non-essential tracking technologies.

6. Third-Party Services and Data Sharing

We share your data with the following third-party service providers, solely for the purposes described. We do not sell your personal data.

Each service provider is bound by a Data Processing Agreement (DPA) that requires them to process your data only on our instructions and in compliance with applicable data protection law.

6.2 Other Disclosures

We may also disclose your personal data:

Law enforcement requests: In response to a valid subpoena, search warrant, court order, or other lawful request from a government authority. This includes requests issued under the U.S. Stored Communications Act as amended by the CLOUD Act (see Section 7.2 below).
National security requests: In response to National Security Letters (NSLs) or orders issued under the Foreign Intelligence Surveillance Act (FISA), to the extent permitted and required by law. We may be prohibited from disclosing the existence of such requests.
Safety and rights protection: To protect the rights, property, or safety of Renkara, our users, or the public.
Business transfers: In connection with a merger, acquisition, reorganization, or sale of assets, in which case the acquiring entity will be bound by this Privacy Policy with respect to your data.

Our commitments regarding government data requests:

We review every government request for legal validity and sufficient scope before producing any data.
We challenge requests that we determine to be overly broad, legally deficient, or otherwise inappropriate, including by seeking to narrow the scope of the request or by filing a motion to quash where warranted.
We will notify affected users of a government data request before producing their data, unless we are legally prohibited from doing so (e.g., by a court-issued gag order or the terms of a National Security Letter). When a non-disclosure obligation expires, we will promptly notify the affected user.
We produce only the specific data responsive to a valid request — we do not provide bulk or indiscriminate access to our systems or databases.

We do not share your data with third parties for their own marketing purposes.

7. International Data Transfers

7.1 Transfer Mechanisms

Renkara is based in the United States. If you are located outside the United States (including in the EEA or UK), your personal data will be transferred to and processed in the United States.

We protect international transfers of personal data using the following safeguards:

Standard Contractual Clauses (SCCs): We use the European Commission's Standard Contractual Clauses (as supplemented where required) for transfers of personal data from the EEA to the United States.
UK International Data Transfer Agreement (IDTA): For transfers from the UK, we use the UK Addendum to the EU SCCs or the UK IDTA as appropriate.
Supplementary measures: We implement the additional technical and organizational measures described in Section 7.3 to ensure an adequate level of protection for your data.

7.2 U.S. CLOUD Act Disclosure

Renkara is a United States corporation. As such, Renkara and its U.S.-based sub-processors (including Amazon Web Services and Twilio/SendGrid) are subject to the Clarifying Lawful Overseas Use of Data Act (CLOUD Act), enacted in 2018 as an amendment to the U.S. Stored Communications Act (18 U.S.C. § 2713).

What this means for your data:

Under the CLOUD Act, U.S. law enforcement authorities may compel Renkara or its U.S.-based sub-processors to produce user data in response to a valid warrant, subpoena, or court order, regardless of whether the data is stored inside or outside the United States.
This means that even if your data is physically stored in a data center located in the European Union or another jurisdiction, it may still be subject to disclosure under U.S. legal process.
The CLOUD Act applies to the content of communications and stored data, as well as to non-content metadata (e.g., subscriber information, session records, IP addresses).

Our position and safeguards:

We will not voluntarily disclose user data to any government authority absent a valid and binding legal process.
We evaluate all U.S. government data requests against applicable law, including by assessing whether the request conflicts with the laws of the country where the data subject resides (including GDPR). The CLOUD Act provides a mechanism for providers to challenge requests that create such conflicts, and we will invoke that mechanism where appropriate.
We maintain the commitments described in Section 6.2 regarding review, challenge, and notification of government data requests.

For EEA and UK users: We recognize that the CLOUD Act was identified by the Court of Justice of the European Union (in Schrems II, Case C-311/18) as a factor relevant to the assessment of U.S. data protection standards. We address this through the supplementary measures described in Section 7.3, in accordance with the European Data Protection Board's recommendations on supplementary transfer measures (Recommendations 01/2020).

7.3 Supplementary Measures for International Transfers

In addition to the Standard Contractual Clauses, we implement the following supplementary technical and organizational measures to protect personal data transferred from the EEA/UK to the United States:

Technical measures:

Encryption in transit: All data transmitted between your device and our servers is encrypted using TLS 1.2 or higher. Internal service-to-service communications within our infrastructure are also encrypted.
Encryption at rest: All personal data stored in our databases and cloud infrastructure is encrypted at rest using AES-256 encryption with keys managed through AWS Key Management Service (KMS). Encryption keys are access-controlled and rotated regularly.
Access controls: Access to personal data is restricted to authorized personnel on a strict need-to-know basis. We use role-based access controls, multi-factor authentication for all administrative access, and centralized credential management through AWS Secrets Manager.
Pseudonymization: Where technically feasible, we pseudonymize personal data so that it cannot be attributed to a specific individual without the use of additional information, which is kept separately and subject to additional access controls.

Organizational measures:

Government access assessment: We have conducted a transfer impact assessment evaluating the risk of government access to transferred data under U.S. law. This assessment considers the legal framework (including the CLOUD Act, FISA, and Executive Order 12333), the practical likelihood of access given the nature and volume of data we process, and the effectiveness of our technical measures.
Commitment to challenge: As described in Section 6.2, we will challenge government data requests that we assess to be overly broad, legally deficient, or in conflict with EU/UK data protection law.
User notification: We will notify affected data subjects of government access requests unless legally prohibited, and will seek to lift any non-disclosure obligations as soon as legally permissible.
Data minimization: We collect and retain only the personal data necessary for the purposes described in this policy (see Section 8), reducing the volume of data potentially subject to government access.
Sub-processor oversight: Our Data Processing Agreements with sub-processors require them to implement equivalent technical and organizational measures and to notify us promptly of any government data requests they receive relating to our users' data.

8. Data Retention

We retain your personal data only for as long as necessary to fulfill the purposes described in this policy, or as required by law. Specific retention periods are:

When the retention period expires, we securely delete or anonymize the data. You may request deletion of your data at any time (see Sections 9 and 10).

9. Your Rights Under GDPR (EEA and UK Users)

If you are located in the European Economic Area or the United Kingdom, you have the following rights under the General Data Protection Regulation (GDPR) and the UK GDPR:

Right of Access (Art. 15): You may request a copy of the personal data we hold about you.
Right to Rectification (Art. 16): You may request that we correct inaccurate or incomplete personal data.
Right to Erasure (Art. 17): You may request that we delete your personal data ("right to be forgotten"), subject to certain legal exceptions.
Right to Data Portability (Art. 20): You may request your personal data in a structured, commonly used, machine-readable format (a ZIP archive containing per-section JSON files), and have it transmitted to another controller.
Right to Restrict Processing (Art. 18): You may request that we limit the processing of your personal data in certain circumstances.
Right to Object (Art. 21): You may object to processing based on legitimate interest or for direct marketing purposes. Where you object to direct marketing, we will stop processing immediately.
Right to Withdraw Consent (Art. 7(3)): Where we process your data based on consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal.
Right to Lodge a Complaint: You have the right to lodge a complaint with your local data protection supervisory authority.

We will respond to all rights requests within 30 days. In complex cases, we may extend this period by an additional 60 days, and we will inform you of any such extension.

10. Your Rights Under CCPA (California Residents)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for collection, and the categories of third parties with whom we share it.
Right to Delete: You may request that we delete the personal information we have collected about you, subject to certain legal exceptions.
Right to Correct: You may request that we correct inaccurate personal information.
Right to Opt-Out of Sale/Sharing: We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising.
Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. You will not receive different pricing, a different quality of service, or be denied service for exercising your rights.

We do not collect: protected classification characteristics, biometric data, sensory data, professional/employment data, education data (beyond study progress within our app), or sensitive personal information as defined by the CPRA.

11. Children's Privacy (COPPA)

We take children's privacy seriously. In compliance with the Children's Online Privacy Protection Act (COPPA):

Users under 13: We do not knowingly collect personal information from children under the age of 13 without verifiable parental consent. If a child under 13 wishes to use the Service, a parent or legal guardian must create the account and provide consent on the child's behalf.
Parental rights: Parents or guardians of children under 13 may:
- Review the personal information we have collected from their child
- Request deletion of their child's personal information
- Refuse further collection or use of their child's information
How to exercise these rights: Contact us at privacy@renkara.com with the subject line "COPPA Request." We will verify your identity as the child's parent or guardian before processing the request.
If we discover unauthorized collection: If we learn that we have collected personal information from a child under 13 without parental consent, we will delete that information promptly.

For users in the EEA/UK, the minimum age for consent to data processing is 16 (or the lower age set by the relevant Member State, which may be as low as 13). Where the user is below the applicable age, we require consent from the holder of parental responsibility.

12. Data Security

When you choose a password, we check it against the Have I Been Pwned breached-password corpus using that service’s range API. Your password never leaves our systems: only the first five characters of its SHA-1 hash are sent, the service returns every hash suffix matching that prefix, and the comparison happens on our side. The service cannot determine your password or identify you from the request.

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These measures include:

Passwords: All user passwords are hashed using bcrypt with an appropriate cost factor. We never store passwords in plaintext.
Encryption in transit: All data transmitted between your device and our servers is encrypted using TLS (Transport Layer Security).
Encryption at rest: Data stored in our databases and cloud infrastructure is encrypted at rest using AWS-managed encryption keys.
Access controls: Access to personal data is restricted to authorized personnel on a need-to-know basis. We use AWS Secrets Manager for secure credential storage.
Infrastructure security: Our infrastructure is hosted on AWS, which maintains SOC 2, ISO 27001, and other industry-standard security certifications.
Session management: Session tokens expire after 30 days and can be invalidated by signing out.
Monitoring: We monitor our systems for security incidents and unauthorized access attempts.

No method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee absolute security.

13. Data Breach Notification

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms:

Supervisory authorities: We will notify the relevant data protection supervisory authority within 72 hours of becoming aware of the breach, in accordance with GDPR Article 33.
Affected individuals: Where the breach is likely to result in a high risk to your rights and freedoms, we will notify you without undue delay, in accordance with GDPR Article 34. Notification will be sent via email to your registered email address.
California residents: We will notify affected California residents as required by California Civil Code § 1798.82.
Content of notification: Breach notifications will describe the nature of the breach, the categories and approximate number of individuals affected, the likely consequences, and the measures taken or proposed to address the breach.

Although not legally required to appoint a Data Protection Officer under GDPR Article 37, we have designated a privacy contact to handle all data protection inquiries:

15. Artificial Intelligence Providers

The Service uses artificial intelligence in two different ways, and they involve different data. This section describes both and names every provider that processes data on our behalf for either purpose. It replaces the narrower “content synthesis only” description in earlier versions of this Policy, which did not account for our interactive study features.

15.1 Content Synthesis — Before You Ever See It

Educational content — knowledge graphs, question banks, lessons, flashcards, scenarios, case studies, glossaries, exam tips, and labs — is generated and verified in advance, offline, and then published into the Service. For that work we send domain and curriculum content only. We do not send your account data, your identity, your learning history, or your telemetry to any provider for content synthesis.

15.2 Interactive Features — While You Study

Some features respond to you in real time: the study assistant, personalized lesson framing, and hints. These features do send your input to an artificial-intelligence provider. There is no way for a feature to answer what you actually asked without sending what you asked.

For an interactive request we send:

the text of your message or request, and the conversation history of that assistant session;
the study context needed to answer it — the course, lesson, question, or concept you are working on, and the relevant portions of our own educational content;
performance signals that let the response meet you where you are — your proficiency rating, number of activities completed, session accuracy, progress in the course, identified weak areas, your recent activity in the course, and, where you have just answered a question, that question and your answer to it.

We do not send your name, email address, password, or payment information as part of an interactive request. The lawful basis for this processing is performance of our contract with you (GDPR Art. 6(1)(b)) — these are features of the Service you signed up for. If you would rather not have your input processed this way, do not use the assistant, hints, or personalized lesson framing; the rest of the Service, including all published lessons, questions, and exams, works without them.

15.3 Providers

The table below lists both the providers we use today and providers we have approved for these purposes and may begin using without a further revision of this Policy. The Status column tells you which is which.

Anthropic’s API operates under a zero-retention policy for API inputs by default. OpenAI states that API inputs are not used to train its models. Each provider’s own published terms govern its handling of the data we send it; we are not responsible for the privacy practices of these third parties, and we encourage you to review their policies. All of them process data in the United States — see Section 7 for the transfer mechanisms and supplementary measures that apply.

We do not send your notes, bookmarks, study sets, or the contents of your account profile to any of these providers, and we do not sell or share your personal data with them for their own purposes, for advertising, or for training their models on you.

If we add a provider outside this table, or use one of these providers for a materially different purpose, we will update this Policy and notify you under Section 17 before the change takes effect.

16. How to Exercise Your Rights

You may exercise any of your data protection rights by:

Marketing opt-out: You can unsubscribe from marketing emails by clicking the "Unsubscribe" link in any marketing email, or by contacting us at the email above.

Verification: To protect your privacy, we will verify your identity before processing any rights request. We may ask you to confirm information associated with your account.

Response time:

GDPR requests: within 30 days (extendable by 60 days for complex requests)
CCPA requests: within 45 days (extendable by an additional 45 days)
COPPA requests: as promptly as possible, typically within 10 business days

No fee: We will not charge a fee for processing your request, unless the request is manifestly unfounded or excessive, in which case we may charge a reasonable fee or refuse the request.

Authorized agents: California residents may designate an authorized agent to submit requests on their behalf. The agent must provide written authorization signed by you, and we may still verify your identity directly.

17. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make material changes:

We will update the "Last Updated" date at the top of this policy.
We will notify you by email and/or through a prominent notice within the Service at least 30 days before the changes take effect.
Where required by law, we will obtain your consent to material changes.

Your continued use of the Service after the effective date of changes constitutes acceptance of the updated policy. If you do not agree with the changes, you may delete your account before the changes take effect.

We encourage you to review this Privacy Policy periodically.

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the AccelaStudy® AI application and related services (collectively, the "Service") provided by Renkara Media Group ("Renkara," "we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

If you are under 18 years of age (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Eligibility

You must be at least 13 years old to use the Service. Users under 13 may only use the Service if a parent or legal guardian creates the account and provides verifiable parental consent in compliance with the Children's Online Privacy Protection Act (COPPA). See our Privacy Policy, Section 11, for details.

For users in the European Economic Area (EEA) or United Kingdom (UK), the minimum age for consent to data processing may be up to 16, depending on your Member State. Where the user is below the applicable age, consent from the holder of parental responsibility is required.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you must register for an account. You may register using:

You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@accelastudy.ai if you become aware of any unauthorized use of your account.

We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4. Use of the Service

4.1 License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial educational purposes.

4.2 Acceptable Use

You agree not to:

Attempt to gain unauthorized access to our systems or other users' accounts

Use automated means (bots, scrapers, etc.) to access the Service
Reproduce, distribute, or create derivative works from the Service's content without our express written permission
Use the Service to transmit malware, spam, or other harmful content
Impersonate any person or entity, or misrepresent your affiliation with any person or entity

4.3 User-Generated Content

You retain ownership of any study sets or custom content you create within the Service ("User Content"). By creating User Content, you grant Renkara a non-exclusive, worldwide, royalty-free license to store, process, and display your User Content solely for the purpose of providing the Service to you.

We do not claim ownership of your User Content, and we will not use it for purposes unrelated to providing the Service without your consent.

4.4 Testimonials and Marketing Consent

If you submit a testimonial through the Service (for example, via your profile page), you may optionally grant Renkara permission to reproduce that testimonial in marketing materials by checking the "Allow Renkara to use this testimonial in marketing" box, or equivalent control, when you submit it ("Marketing Consent").

When you grant Marketing Consent, you grant Renkara a non-exclusive, worldwide, royalty-free, sublicensable license to reproduce, display, adapt (including for length and clarity), and distribute the testimonial, together with your display name and avatar image as they appear in your profile at the time of display, in any medium and for any promotional or marketing purpose connected to the Service. You represent and warrant that the testimonial is your own original work and that you have the right to grant this license.

Revocation: You may revoke Marketing Consent at any time by editing the testimonial to remove consent, by deleting the testimonial entirely, or by emailing legal@renkara.com. Revocation takes effect prospectively: we will remove the testimonial from materials we control promptly (typically within fourteen days), but revocation does not require us to recall copies of materials already distributed (for example, print collateral already in circulation, or social posts already reshared by third parties).

If you do not grant Marketing Consent, your testimonial is used solely within the Service and for internal product purposes; we will not publish, quote, or otherwise use it externally.

5. Subscriptions, Free Trials, and Billing

This section applies to subscriptions you buy for yourself. Seats an organization buys for its members (for example, school, company, or program seats) are governed by that organization's agreement with us.

5.1 One Product per Subscription

Each subscription is for one AccelaStudy® AI product (for example, AccelaStudy® AI Certs or AccelaStudy® AI Test Prep) and gives you access to that product only. A subscription cannot be changed, transferred, or converted to a different product. To use another product, buy a separate subscription to it. You may hold one subscription to each product at a time. Within a subscription, you may switch between monthly and annual billing as described in Section 5.6.

5.2 Where You Subscribe and Who Bills You

You can subscribe:

on our website, where payments are processed by our payment processor, Stripe, Inc. We do not store your full card number;
in our iPhone and iPad apps, through the Apple App Store; or
in our Android apps, where available, through Google Play.

Where you subscribe determines who bills you, how you cancel, and how refunds are handled. App Store and Google Play purchases are also subject to Apple's or Google's terms, and Apple or Google manages the billing relationship for them.

5.3 The 7-Day Free Trial

(a) New subscriptions to paid products begin with a 7-day free trial, unless we tell you otherwise before you subscribe. If you already have free access to a product that we gave you when you signed up, and you start that product's free trial before that access runs out, your free trial ends when that access does, which may be sooner than 7 days. The date of the first charge that we show you before you start (paragraph (c)) reflects this.

(b) To start a free trial, you must provide a payment method: a payment card on our website, or the account you use with the App Store or Google Play. When you add a card, your card issuer may show a small temporary authorization that verifies the card. It is not a charge, and your issuer releases it.

(c) We do not charge you during the free trial. When the trial ends, your paid subscription begins, and we (or Apple or Google) charge your payment method the price of the billing period you chose, monthly or annual. We show you that price and the date of the first charge before you start the trial, and again in the confirmation we send you. An annual subscription is charged for the full year when the trial ends.

(d) On our website, you may receive one free trial of each product. We determine whether you are eligible from your account and the payment card you use: a card that has already been used for a free trial of a product on our website, on any account, cannot be used for another free trial of that product, and prepaid cards are not eligible for free trials. Free access we gave you when you signed up (paragraph (a)) is not a free trial for this purpose. If you are not eligible, we will tell you before you subscribe, and you may choose to subscribe without a free trial, in which case you are charged when you subscribe. For App Store and Google Play purchases, Apple and Google decide eligibility for free trials under their own rules, and those free trials are separate from free trials on our website.

(e) When your free trial starts, we send you a confirmation that states the date and amount of the first charge and how to cancel. If you have not canceled, we also send you a reminder with the same information about 48 hours before the first charge. If your free trial is shorter than 7 days (paragraph (a)), the reminder may arrive closer to the charge, or not at all for a trial that ends within a few hours; the confirmation always carries the same information.

(f) If you cancel during the free trial, you will not be charged, and you keep access until the trial ends.

(g) If the first charge after the free trial fails, your access to the product is paused until the payment succeeds. If the payment still has not succeeded after our retry attempts, your subscription ends.

5.4 Automatic Renewal

Your subscription renews automatically. After the free trial, your subscription continues, and at the end of each billing period (every month or every year, as you chose) it renews and we (or Apple or Google) charge your payment method the price then in effect for the next period, until you cancel. By starting a free trial or subscription on our website, you authorize us, through Stripe, to charge your payment method for the first charge and each renewal until you cancel. Please keep your payment information current. If a renewal payment fails, we may retry it, and we may suspend your access until it succeeds. If the price of your subscription changes, we will tell you at least 30 days before the new price applies to a renewal, and you may cancel before then. Prices are shown in U.S. dollars. Prices do not include taxes, which we add where required.

5.5 How to Cancel

You may cancel at any time, and cancellation stops all future charges. If you cancel before your free trial ends, you will not be charged. Cancellation takes effect at the end of the current free trial or billing period, and you keep access until then.

Website subscriptions: in the app, open Profile → Subscription and select Cancel for the subscription you want to end, or use the link to manage your subscription in any billing email we send you. You may also email us at support@accelastudy.ai and ask us to cancel.
App Store subscriptions: on your iPhone or iPad, open Settings, tap your name, then tap Subscriptions. Apple requires you to cancel at least 24 hours before the free trial or the current period ends to avoid the next charge.
Google Play subscriptions: in the Google Play Store app, open Payments & subscriptions, then Subscriptions.

Deleting the app does not cancel a subscription. App Store and Google Play subscriptions continue until you cancel them with Apple or Google.

5.6 Changing Your Billing Interval

Within a subscription, you may switch between monthly and annual billing for the same product. During a free trial, the switch does not change when the trial ends, and your first charge is at the new billing period's price. After the free trial, the switch takes effect immediately, and the unused part of your current billing period is credited against your next charge. A credit is applied to your subscription; it is not a refund, and it is not paid out.

5.7 Refunds

(a) Website subscriptions. All charges are final and non-refundable, including the first charge after a free trial ends. We do not provide refunds or credits for partial billing periods or unused time, except the credit described in Section 5.6 or where the law requires it. Cancellation stops future charges; it does not refund past ones. The free trial, and the reminder we send before your first charge, are there so you can decide before you pay.

(b) App Store and Google Play subscriptions. Refunds for these purchases are handled by Apple or Google under their own policies, and we cannot issue them. To request a refund, contact Apple or Google.

(c) Consumers in the United Kingdom. If you live in the United Kingdom, you have the rights the law of the United Kingdom gives you to cancel a subscription and receive a refund, including any right to cancel after a free trial converts to a paid subscription. Where those rights apply, they take precedence over paragraph (a).

(d) Consumers in the European Economic Area. If you live in the European Economic Area, you have the rights the law of your country gives you, including any right to withdraw from a contract for digital content and receive a refund. Where those rights apply, they take precedence over paragraph (a).

(e) Nothing in this section limits any right to a refund or other remedy that you have under the law of the place you live and that cannot be waived by agreement.

6. Intellectual Property

6.1 Our Content

The Service, including its design, text, graphics, interfaces, code, and all content provided by Renkara (excluding User Content), is owned by Renkara and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

6.2 Trademarks

"AccelaStudy," "Renkara," and associated logos are trademarks of Renkara Media Group. You may not use these trademarks without our prior written consent.

7. Data Protection and Your Rights

We are committed to protecting your personal data and respecting your privacy rights. This section summarizes key commitments; our Privacy Policy provides full details.

7.1 GDPR Data Subject Rights (EEA/UK Users)

If you are located in the EEA or UK, you have the following rights under the General Data Protection Regulation:

Access your personal data
Rectify inaccurate or incomplete data
Erase your personal data ("right to be forgotten")
Port your data to another service in a structured, machine-readable format
Restrict processing in certain circumstances
Object to processing based on legitimate interest or for direct marketing
Withdraw consent at any time where processing is based on consent

We will respond to all rights requests within 30 days.

7.2 Right to Delete Your Account and Data

You may delete your account and all associated personal data at any time by:

Using the account deletion feature in the app's settings, or

Upon account deletion, we will delete or anonymize your personal data within 30 days, except where retention is required by law (e.g., financial records related to purchases).

7.3 Data Portability

You may request a copy of your personal data in a structured, commonly used, machine-readable format (a ZIP archive containing per-section JSON files). To make a data portability request, contact privacy@renkara.com.

7.4 Consent Withdrawal

Where we process your data based on consent (such as marketing communications), you may withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

Adjusting your preferences in the app settings

7.5 U.S. Law and Government Access

The Service is operated from the United States by a U.S.-incorporated entity. As such, Renkara and its U.S.-based infrastructure providers are subject to U.S. law, including the Clarifying Lawful Overseas Use of Data Act (CLOUD Act), the Stored Communications Act, the Foreign Intelligence Surveillance Act (FISA), and other laws that may require disclosure of user data to U.S. government authorities.

By using the Service, you acknowledge that your data may be accessed by U.S. authorities pursuant to valid legal process, regardless of where the data is physically stored. Our Privacy Policy, Sections 6.2 and 7.2, describe in detail our commitments regarding government data requests, including our policies on legal review, challenging overbroad requests, and user notification.

For users in the EEA and UK, our Privacy Policy, Section 7.3, describes the supplementary measures we implement to protect your data in light of these U.S. legal obligations.

7.6 Breach Notification

In the event of a personal data breach that poses a risk to your rights and freedoms, we commit to:

Notifying the relevant supervisory authority within 72 hours of becoming aware of the breach (per GDPR Article 33)
Notifying affected users without undue delay where the breach poses a high risk (per GDPR Article 34)
Notifying affected California residents as required under California Civil Code § 1798.82

8. AI-Generated Content

Learning content in the Service is generated by artificial intelligence and may contain errors. This includes lessons, questions and answer options, answer explanations, flashcards, scenarios, case studies, glossaries, exam tips, and labs. It is study material. It is not professional, legal, medical, financial, or academic advice, and it is not a substitute for an official curriculum, an accredited course of instruction, a certification vendor’s own materials, or the judgment of a qualified professional.

We do not simply publish raw model output. Every item is produced through a multi-stage synthesis and verification process — patent pending — in which candidate content is independently reviewed, adversarially challenged, and checked for support against the source material it was derived from before it is published; content that fails review is regenerated or withheld rather than served to you. This process virtually eliminates factual defects. It does not guarantee their absence, and we do not represent that it does.

Some features generate responses in real time, shaped by what you ask and how you have answered — including the study assistant, personalized lesson framing, and hints. Real-time responses are not subject to the pre-publication review described above and should be treated with correspondingly greater caution. For what is sent to our artificial-intelligence providers when you use these features, see our Privacy Policy, Section 15.

You are responsible for verifying any content on which you intend to rely, particularly where an examination, a certification, a licensing decision, an academic submission, or a professional, financial, or safety consequence depends on it. Examination and certification results depend on many factors outside our control, and we do not guarantee any particular outcome.

If you believe a piece of learning content is wrong, please tell us at support@accelastudy.ai. We review reports and correct or withdraw content we confirm to be defective.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. We do not guarantee any specific learning outcomes from your use of the Service.

WITHOUT LIMITING THE FOREGOING, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO (A) THE APPLICATION, ITS AVAILABILITY, AND ITS FREEDOM FROM DEFECTS; (B) THE ARTIFICIAL-INTELLIGENCE AND MACHINE-LEARNING MODELS USED IN OR BY THE SERVICE, INCLUDING MODELS OPERATED BY THIRD PARTIES AND THE OUTPUT THEY PRODUCE; AND (C) THE LEARNING CONTENT, INCLUDING ITS ACCURACY, COMPLETENESS, CURRENCY, ORIGINALITY, FITNESS FOR EXAMINATION PREPARATION, AND ALIGNMENT WITH ANY PARTICULAR EXAMINATION BLUEPRINT, SYLLABUS, CERTIFICATION OBJECTIVE, OR VERSION OF A CERTIFICATION.

In plain terms: the application may have bugs, the models may be wrong, and the content may contain mistakes despite the verification process described in Section 8. Certification objectives and examination blueprints also change over time, and content that was accurate when it was published may cease to reflect the current examination. We do not guarantee any specific learning outcome, examination score, pass result, or certification.

Nothing in these Terms excludes or limits our liability for (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, or (c) any liability that cannot be excluded or limited by applicable law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RENKARA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

THE DAMAGES EXCLUDED AND LIMITED BY THIS SECTION INCLUDE, WITHOUT LIMITATION, THOSE ARISING FROM OR RELATED TO A DEFECT OR ERROR IN THE APPLICATION, IN ANY ARTIFICIAL-INTELLIGENCE OR MACHINE-LEARNING MODEL USED BY THE SERVICE, OR IN ANY LEARNING CONTENT OR REAL-TIME RESPONSE THE SERVICE PROVIDES — INCLUDING RELIANCE ON INCORRECT CONTENT, A FAILED OR MISSED EXAMINATION, A LOST OR DELAYED CERTIFICATION OR LICENSING OPPORTUNITY, AN ACADEMIC PENALTY, OR ANY OTHER PROFESSIONAL OR FINANCIAL CONSEQUENCE OF USING THE SERVICE.

These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages.

For EEA/UK users: Nothing in this section affects your statutory rights as a consumer under applicable EU or UK law, including your right to a remedy for non-conforming digital content or services under the Consumer Rights Act 2015 (UK) or the EU Digital Content Directive.

11. Indemnification

You agree to indemnify and hold harmless Renkara, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Any User Content you create or submit

12. Governing Law and Dispute Resolution

12.1 For Users in the United States

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.

Arbitration: Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in the State of Texas. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.

Class Action Waiver: YOU AGREE TO WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST RENKARA.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdictional amount.

Opt-Out: You may opt out of the arbitration agreement by sending written notice to legal@renkara.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the state or federal courts of Texas.

12.2 For Users in the European Economic Area and United Kingdom

If you are a consumer in the EEA or UK:

These Terms shall be governed by the laws of your country of habitual residence, in addition to mandatory provisions of EU/UK law, including the General Data Protection Regulation (EU 2016/679) and the UK GDPR.
The arbitration clause in Section 12.1 does not apply to you to the extent it conflicts with mandatory consumer protection laws in your jurisdiction.
You may bring proceedings in the courts of your country of habitual residence or in the courts of Texas, at your choice.
You retain all mandatory consumer rights granted by the laws of your jurisdiction, and nothing in these Terms limits those rights.
You may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr to resolve disputes.

12.3 For Users in Other Jurisdictions

These Terms shall be governed by the laws of the State of Texas, except to the extent that mandatory local laws in your jurisdiction require otherwise. The arbitration provisions of Section 12.1 apply, except where prohibited by your local law.

13. Termination

13.1 By You

You may terminate your account at any time by deleting it in the app's settings or by emailing support@accelastudy.ai. Before you delete your account, cancel any active subscription as described in Section 5.5. App Store and Google Play subscriptions continue to bill until you cancel them with Apple or Google.

13.2 By Us

We may suspend or terminate your account if:

You breach these Terms
Your use of the Service poses a security risk or legal liability
We are required to do so by law
We discontinue the Service (with reasonable notice)

Before terminating your account for a breach, we will provide you with notice and an opportunity to cure the breach where practicable, unless the breach poses an immediate risk to the Service or other users.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will delete or anonymize your personal data in accordance with our Privacy Policy, Section 8 (Data Retention). You may request a copy of your data before account deletion (see Section 7.3).

14. Modifications to These Terms

We may modify these Terms from time to time. When we make material changes:

We will update the "Last Updated" date at the top of these Terms.
We will notify you by email and/or through a prominent notice within the Service at least 30 days before the changes take effect.
Where required by applicable law, we will obtain your consent to material changes.

If you do not agree to the modified Terms, you may delete your account before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Renkara regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.

15.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or failures of third-party services.
